In Westbrook Dolphin Square Ltd v Friends Life Ltd [2012] EWCA Civ 666, the Court of Appeal has allowed the appeal of the nominee purchaser in a collective enfranchisement claim concerning Dolphin Square which was, when built, the largest block of flats in Europe. The High Court had struck out the claim on the ground that it was an abuse of process, following the withdrawal of an earlier claim. On appeal it was held that the Leasehold Reform, Housing and Urban Development Act 1993 gave tenants an unqualified right to make successive claims, provided they waited a year after withdrawal of a previous notice. Nicholas Dowding QC and Anthony Radevsky acted for the Appellant and Stephen Jourdan QC acted for the Respondent.
