S Franses Ltd v The Cavendish Hotel (London) Ltd
Guy Fetherstonhaugh QC and Nicholas Taggart of Landmark Chambers are instructed to represent the Cavendish Hotel in S Franses Ltd v The Cavendish Hotel (London) Ltd in forthcoming appeals in both the Court of Appeal and the Supreme Court. Among the issues raised by the proceedings are (1) what works of construction should be left out of account when considering a landlord’s ground of opposition under s.30(1)(f) of the the Landlord and Tenant Act 1954; and (2) whether the landlord’s motive in forming the requisite intention is of any relevance. The outcome of these appeals is likely to be of considerable importance for business tenants and landlords.
