Roll up, roll up. Some bets are back on! The eviction of squatters gets the green light.
The Master of the Rolls has today informed the PBA and PLA that he will make an amending Practice Direction which exempts from the PD 51Z general stay of possession proceedings: (1) claims against trespassers (persons unknown); (2) applications for interim possession orders; (3) applications for agreed case management directions.
The amending PD also clarifies that PD 51Z does not preclude claims being issued; it only bars their progression.
Not quite ‘business as normal’ just yet – but the tentacles of PD 51Z are trimmed.
