The First Tier Tribunal has now delivered its fully-reasoned written judgment in the Gravesham case, which answers the question as to whether paragraph 20 of the Code is available where an operator is liable to be removed under Part 6 of the Code in the affirmative. This is subject to the Tribunal’s powers to regulate its own processes.
