Khans Solicitors v Chifuntwe and Secretary of State for the Home Department [2013] EWCA Civ 481
On 8 May 2013, the Court of Appeal gave judgment in the second appeal in Khans Solicitors v Chifuntwe and Secretary of State for the Home Department [2013] EWCA Civ 481. The leading judgment of Sir Stephen Sedley is the first authoritative decision of the Court of Appeal for over 100 years on the solicitor’s so-called lien for his costs. It considers the circumstances in which a solicitor can set aside a compromise reached by his lay client with the other side, and when, if that attempt fails, the solicitor can look to the other side for his costs.
