Cooper v Ludgate House Ltd and Powell v Ludgate House Ltd (known as the “The Bankside Yards rights of light cases”) are featured by The Lawyer in an article titled “ Neighbour wars: Two firms’ offices at risk of demolition”.
Kester Lees KC (led by John McGhee KC of Wilberforce Chambers) acts for the developer of the award winning Bankside Yards development, in two cases in which two neighbours are seeking injunctions to force the developer to demolish or significantly alter Arbor, an award-winning 18-storey office block on the basis of an alleged actionable infringement with their rights of light.
Kester was instructed by Matthew Baker, Sarah Campey and Pierre Smith of Pinsent Masons LLP.
The trial concluded in April 2025, with a court decision expected by July.
