In Fitzpatrick v Sarcon (No 177) Ltd, Guy Fetherstonhaugh QC and Michael Humpheys QC, instructed by Carson McDowell, acted for the successful appellant in the Court of Appeal of Northern Ireland in a dispute concerning the proper interpretation of a number of agreements for a residential development by Belfast Docks. The principal issues were whether time was of the essence of the contractual completion dates; and whether an agreed procedure for extension of the completion date required the service of a notice for its initiation.
