Cecily Crampin co-authors article on Mortgage Enforcement
Cecily Crampin co-authored an article with Professor Lisa Whitehouse of Southampton University titled “Missing in action? Mortgage enforcement under section 126 of the Consumer Credit Act 1974.”
The article considers Section 126 of the Consumer Credit Act 1974 and that it requires nearly all residential mortgage agreements to be enforced by court order, and many accounts of the law of mortgage will require revision. It is important to ensure accurate knowledge of section 126 is conveyed to those who advise mortgagors at risk of possession.
