Mark Sefton KC recently acted for the successful Respondents in Mohammed v. Daji [2024] EWCA Civ 1247 (Newey, Arnold, Zacaroli LJJ)
The appeal was about the ownership of a 16-acre development site in West Ham. The site had been bought in the 1990s by adherents of the Tablighi Jamaat movement of Sunni Islam. In 2017, there was a schism in the movement, which divided into two opposing factions, and the factions disputed the owership of the land. The Respondents said it was held on trust for the London community of Tablighi Jamaat followers. The Appellants said that it was held on trust for a charity based in Dewsbury, that was associated with the leadership of the movement in the UK prior to the schism. The trial Judge held in favour of the London community. The Dewsbury charity appealed and, following a two-day hearing, the appeal has now been dismissed.
