Property Pointers Zoominar Series

Falcon Chambers is pleased to announce that our Zoominar Series - 'Property Pointers' will start at the end of October. We will be offering a series of zoominars on various aspects of property law. These will be presented by junior counsel and aimed particularly at solicitors up to 5 years’ PQE, they would also be useful to surveyors and other professionals working in the property industry.

Each seminar will last for 45 minutes. There will be 15 minutes for questions at the end.

Monday 28 October at 17:00 - 18:00

Preparing and Serving Property Notices: Practical and Substantive Issues – Thomas Rothwell and Ashpen Rajah

In this session, Thomas and Ashpen will consider commonly encountered issues arising out of the service of property notices, including the requirements of a valid notice, the interpretation of notices and the requirements for proper service, as well as other common pitfalls. The focus will be on providing practitioners with a practical framework for avoiding disputes in the first place or, if they cannot be avoided, resolving them.

Thursday 14 November at 17:00 - 18:00

Co-ownership: Principles, Practice and Procedure  Fern Schofield and Richard Miller

The talk will cover key issues in co-ownership from the beginning to the end of a dispute, including recent case law on the ascertainment of beneficial interests, occupation rent, procedural pitfalls and remedies including orders for sale.

Interim Injunctions: (i) what judges worry about and (ii) recent developments concerning protestors – Michael Ranson and Taylor Briggs 

Practitioners will be familiar with the theory behind ‘American Cyanamid’ but this session will guide attendees through the issues which tend to play on judges’ minds when asked to grant, often urgent, interim injunctions in the real world.  There will be a particular focus on the developing law relating to protestors.  If you have ever wondered about the role of a cross-undertaking in damages or what ‘preserving the status quo’ really means, this is a session for you.

Civil and criminal nuisance: What's the difference? Which is the right one for me? – Edward Blakeney and Kavish Shah

Civil nuisance has been in the spotlight recently with a series of Supreme Court judgments. Criminal nuisance cases brought under the Environmental Protection Act 1990, which are prosecuted in the Magistrates' Courts, may be less familiar to practitioners. In this talk, Edward and Kavish recap the law on civil nuisance and its developments, and then consider how criminal nuisance differs from civil nuisance as well as the benefits and burdens of bringing such a case.
